The terms and conditions governing our professional services and client relationships.

Agreement to Terms

By engaging JPX Tax Advisory for professional services or using our website, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and JPX Tax Advisory (ABN: 62 881 803 693).

Jay Phang is a registered tax agent (Registration No. 26302263) with the Tax Practitioners Board and is bound by the Tax Agent Services Act 2009 (Cth) and the Code of Professional Conduct.

Our Services

Professional Services Include:

  • Individual and business tax return preparation and lodgment
  • Business Activity Statement (BAS) preparation and lodgment
  • Tax planning and advisory services
  • Self-Managed Super Fund (SMSF) services
  • ATO representation and dispute resolution
  • Business structuring advice
  • General tax and financial advisory services

Service Limitations:

  • We do not provide financial product advice or investment recommendations
  • We do not provide legal advice (we may refer you to appropriate legal professionals)
  • Services are limited to Australian taxation and regulatory matters
  • All advice is based on current legislation and ATO interpretations
Client Responsibilities

As our client, you agree to:

  • Provide complete, accurate, and timely information
  • Disclose all relevant financial information and circumstances
  • Maintain proper records and documentation
  • Respond promptly to our requests for information
  • Pay fees and charges in accordance with our fee agreement
  • Notify us of any changes to your circumstances
  • Review all documents before signing or lodgment
  • Comply with all applicable laws and regulations
Fees and Payment Terms

Fee Structure:

  • Fees are based on time, complexity, and value of services provided
  • Fixed fees may be quoted for standard services
  • Additional charges may apply for urgent or complex matters
  • All fees are quoted excluding GST (where applicable)

Payment Terms:

  • Payment is due within 14 days of invoice date
  • We accept bank transfer, credit card, and other agreed payment methods
  • Interest may be charged on overdue accounts
  • We reserve the right to suspend services for unpaid accounts
  • Refunds are at our discretion and subject to work completed
Professional Standards and Conduct

We are committed to maintaining the highest professional standards:

  • Compliance with the Tax Agent Services Act 2009 and Code of Professional Conduct
  • Maintaining professional indemnity insurance
  • Continuing professional development and education
  • Confidentiality and privacy protection
  • Acting in your best interests within legal and ethical boundaries
  • Providing competent and diligent service
  • Avoiding conflicts of interest
Liability and Disclaimers

Limitation of Liability:

  • Our liability is limited to the extent permitted by law
  • We maintain professional indemnity insurance
  • Liability for any claim is limited to the fees paid for the relevant service
  • We are not liable for consequential or indirect losses

Disclaimers:

  • Advice is based on information provided and current law at the time
  • Tax laws and interpretations may change
  • We are not responsible for decisions made without our advice
  • Website information is general in nature and not personal advice
Confidentiality

We are committed to maintaining strict confidentiality:

  • All client information is kept strictly confidential
  • Information is only disclosed with your consent or as required by law
  • Staff are bound by confidentiality agreements
  • Secure systems and procedures protect your information
  • Confidentiality continues after the end of our professional relationship
Termination of Services

Either party may terminate our professional relationship:

  • With reasonable notice in writing
  • Immediately for breach of these terms
  • We may terminate for non-payment of fees
  • We may terminate if we cannot act in your best interests
  • Upon termination, you remain liable for fees incurred
  • We will provide reasonable assistance with transition to new advisors
  • Client files will be retained as required by professional standards
Governing Law and Disputes

These terms are governed by the laws of New South Wales, Australia.

In the event of a dispute:

  • We encourage direct discussion to resolve issues
  • Complaints may be made to the Tax Practitioners Board
  • Mediation may be used before legal proceedings
  • NSW courts have jurisdiction for any legal disputes
